Consequently, the customer acknowledges that he/she has been fully informed that his/her agreement to the content of these general terms and conditions of sale does not require the handwritten signature of this document, insofar as the customer wishes to order online the products presented in the knifeleader.eu store. The customer has the option of saving or printing these general terms and conditions of sale, it being understood that the retention of this document is the sole responsibility of the customer.
The customer, prior to placing an order, declares that the purchase of these products is not directly related to his professional activity, their purchase being reserved for his personal use. Article 2 : Purpose
The purpose of these general conditions of sale is to define the rights and obligations of each party in the context of the online sale of goods offered by L&W to its customers.
Article 3 : Commencement and duration
These general terms and conditions of sale come into force on the date of the order form. The present general conditions are concluded for the necessary duration for the supply of the purchased goods, until the extinction of the guarantees due by the company L&W.
Article 4 : Electronic approval
The customer's "click" on the order form constitutes an electronic signature which has the same value between the parties as a handwritten signature.
Article 5 : Order confirmation
Contractual information will be confirmed by e-mail at the latest at the time of delivery or, failing that, at the address indicated by the customer on the order form.
Article 5.1 : Weapons
For all purchases of edged weapons (knives, daggers, swords, axes, etc.), the customer certifies that he/she is of legal age when ordering. L&W cannot be held responsible in the case of a purchase for a third party.
Article 6 : Transaction proof
Computerized registers, kept on the servers of L&W's hosting company under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties. Purchase orders and invoices are archived on a reliable, durable and secure medium, which may be produced as proof if required.
Article 7 : Products informations
The company L&W presents on its website knifeleader.eu the products to be sold with the necessary characteristics that allow compliance with Article L 111-1 of the Customer Code, which provides the opportunity for the potential customer to know before the final order the essential characteristics of the product he wishes to acquire.
Article 8 : Stock
The offers presented by L&W are only valid while stocks last.
Article 9 : Prices
Prices are quoted in euros and British Pound Sterling and are only valid on the date the order form is sent by the customer. They do not include shipping costs, which are surcharged, but are clearly visible from the start of the purchasing process. For all EU countries, prices are inclusive of VAT on the date of order, and any change in the applicable VAT rate will be automatically reflected in the price of knifeleader.eu products. The full price of the items must be paid when ordering. At no point the sums paid may be considered or transformed as deposits or advance payments.
Article 10 : Promotional codes
The Knifeleader.eu site can communicate to its users promotional codes that can be used 1 or more times, depending on the case, within a given period of time or within the limit of available stocks if it concerns a product offered.
Knifeleader.eu reserves the right to discontinue or modify at any time and without notice a discount code if it was shared publicly. The fraudulently shared code(s) may be modified or deactivated as well as all orders associated with such code(s) without prior notice.
Article 11 : Payment
To pay for his order, the customer has, at his choice, all the methods of payment mentioned at the foot of the order form. The customer certifies that he/she has the necessary authorizations to use the method of payment when validating the order form with L&W.
The company L&W reserves the right to suspend any order as well as any delivery in the case of a refused authorization of payment on behalf of the officially accredited organizations or in the case of a payment refused by its bank.
L&W reserves the right to refuse to make a delivery or to honor an order from a customer who has not paid in full or in part for a previous order. This applies for as long as the payment conflict exists.
For all orders over 500 euros and/or made from abroad and/or with a foreign credit card, L&W's administrative department reserves the right to carry out an identity verification to ensure that no one is using another person's payment details without their knowledge. In case of suspicion of fraud, L&W reserves the right not to proceed with the shipment of the order.
Payment methods vary according to the customer's country and the destination of the parcel : Credit Card (Visa, Mastercard, CB), bank transfer, Paypal, Apple Pay, Google Pay or Bancontact. Cheques are not accepted.
Article 12 : Shipping times and product availability
The order will be executed at the latest within 3 to 4 working days from the day following the one when the customer has placed and paid for his order. (See also company info at the bottom of the page: Stock and delivery). Orders paid by bank transfer will be shipped upon receipt of the transfer.
In the case of unavailability of the product ordered, the customer will be informed at the earliest within 5 working days and will have the option of cancelling the order in part or in full. The customer will then have the option of being reimbursed for the amount paid within 14 days at the latest, at his or her own request, or of substituting the missing product with another of the same or lower value. Refunds will only be made according to the means of payment initially used by the customer. L&W gives the customer the option of receiving a credit note for the amount for future use.
Article 13 : Terms of delivery
Article 13.1 : delivery in France
The products are delivered to the address indicated by the customer on the order form in metropolitan France. Delivery means "transfer to the customer of physical possession or control of the good" Art. L. 138-1 Law n°2014-344.
Delivery without signature: carrier's proof of delivery
The customer is responsible for his choice of delivery and acknowledges that delivery without a signature - by its nature - transfers responsibility for the parcel from the carrier to the customer from the moment the parcel is delivered to the letterbox or to a third party at the delivery address. Only the carrier's proof of delivery is valid. It is then up to the customer to turn directly to the carrier in the case of disagreement.
This responsibility can be transferred by delivery with signature, ensuring that the customer receives the correct delivery. To do this, the customer must opt for Colissimo home delivery with signature.
Correct delivery address
Customers are responsible for the delivery address they provide. It is the customer's responsibility to provide as much information as possible to ensure correct delivery of the parcel. If the delivery is not able to proceed due to an incomplete or incorrect address, the actual delivery costs for reshipment will be charged to the customer. These costs must be paid by the same means of payment used for the initial order, before the parcel is resent.
Receipt on delivery
The customer is required to check the condition of the package upon receipt. If the package is damaged or abnormally light, the customer must open it in front of the delivery person to check the condition of the products. The parcel must be refused if the customer notices a missing or damaged product. Any damage or missing products due to the carrier must be reported on the delivery note (with signature), and to L&W, within 5 working days.
Delivery without signature
In the case of a shipment without a signature, it may be sent by DPD, Colissimo or Chronopost.
Delivery by La Poste
In the case of absence during home delivery, a delivery notice will be left in the letterbox, allowing the parcel to be collected at the post office indicated during opening hours, within 15 days.
In the case of a delay in delivery relative to the date indicated in the shipping email, the customer must report the delay by contacting L&W Customer Service, which will launch an investigation with La Poste.
The investigation may take up to 30 days from the start date of the investigation. If the product is found during this period, it will be redirected immediately. If, on the other hand, the product is not found at the end of the 30-day investigation period, the Post Office will consider the parcel lost and L&W will return the goods at its expense.
If the product(s) ordered were no longer available at that time, L&W will refund the amount of the products concerned by the carrier's loss.
L&W declines all responsibility for any extension of delivery times due to the carrier, particularly in the case of loss of products or strikes.
Parcels returned to sender
Situation 1: The carrier returns the package to L&W and the customer is not liable. For example, the shipping label was damaged during transport, preventing delivery of the parcel; the carrier attempted to deliver to an absent customer and returned the parcel directly to L&W without even dropping it off at the post office; the carrier returned the parcel because the relay point chosen by the customer was closed, without attempting to deliver the parcel to an alternative relay point.
Upon receipt of the returned parcel, L&W will contact the customer to offer to return the parcel at no extra cost.
Situation 2: The carrier returns the package to L&W and the customer is held responsible. For example, the customer has provided L&W with an incorrect or incomplete address; the customer's name is not marked on the letterbox at the address indicated; the customer has not collected the parcel from the relay point during the storage period.
Upon receipt of the returned parcel, L&W undertakes to contact the customer to propose a return of the parcel or a refund. If the customer chooses to return the parcel, they will have to pay the sum of €6.99 to cover the cost of returning the parcel with Colissimo.
Article 13.2 : delivery in Europe and United Kingdom
The products are delivered to the address indicated by the customer on the order form in Europe or in the United Kingdom. Delivery means "transfer to the customer of physical possession or control of the good" Art. L. 138-1 Law n°2014-344.

Article 14 : Delivery problems caused by the carrier
Any anomaly concerning the delivery (damage, missing product compared with the delivery note, damaged package, broken product, etc.) must be indicated on the delivery note in the form of "handwritten comments", accompanied by the customer's signature. At the same time, the customer must confirm this problem by sending a registered letter with acknowledgement of receipt to the carrier within two working days of the delivery date, setting out the aforementioned complaints. The customer must send a copy of this letter by e-mail or by post to : L&W KNIFE LEADER, Customer Service, 245 Allée Louis Blériot, Résidence Mandelieu 2000 - 06210 MANDELIEU - France.
In this way, the company will be able to replace the damaged product or offer a refund, and will be able to assert its rights against the carrier.
Article 15 : Product warranty
In accordance with Article 4 of Decree No. 78-464 of March 24, 1978, the provisions hereof shall not deprive the customer of the legal warranty which obliges the professional seller to guarantee against all consequences of latent defects in the item sold. The customer is expressly informed that L&W is not the producer of the products presented on the knifeleader.eu website, in the sense of the French law no. 98-389 of May 19 1998 concerning liability for defective products.
Consequently, in the event of damage caused to a person or property by a defect in the product, only the liability of the producer of the product may be sought by the customer, on the basis of the information appearing on the packaging of the said product. The conditions and duration of the producer's warranty are indicated on the product sheets.
It is important to note that rusty knives or utensils are not covered by the warranty, as rust is not considered a product defect, whatever the length of use (short or long). In fact, rust is the result of too many environmental factors, as well as or inappropriate use or maintenance.
Article 16 : Returns and Right of Withdrawal
Article 16.1 : Returns and right of withdrawal in France
Exercise the right of withdrawal within 60 days by contacting Customer Services
The customer has a period of 60 days from the day after delivery of the products to exercise his right of withdrawal on products that do not suit him. Products must be new, unused and in undamaged packaging. This right of withdrawal must be asserted by email or post to L&W Customer Service.
This period runs from receipt of the order by the customer. If this period expires on a Saturday, Sunday or public holiday, it is extended to the next working day.
In order to speed up the refund process, it is advisable to follow the logistical product return procedure, i.e. to obtain a return number from L&W Customer Service.
This return number will give the customer a further 7 days from the date of obtaining the return number to return the products, at his or her own expense. The product must be returned to an address provided by L&W.
Free returns from Metropolitan France
In order to be exempt from return shipping costs, the following conditions must be met: the return request must be made within 60 days of the day following the delivery of the products; the package must be returned from metropolitan France; the returned product must be new and unused, in its packaging and in perfect condition.
The return request must be made by email, post or telephone. If the conditions are met, L&W Customer Service will send the customer a Colissimo return label by email, which must be affixed to the parcel. The package must be delivered to the post office within 7 days of receiving the return label by email.
Conditions for returnable products
Returned products must be new and unused, in their original packaging, complete and undamaged (including accessories and documentation), and in perfect condition for resale. Any product that has been used, damaged, soiled or consumed (in the case of consumables), or whose original packaging has been damaged in such a way as to compromise its resale, may not be returned. Gift vouchers and items that are the result of a personalized order (knives with personalized engraving, for example) will also not be taken back.
If the product packaging is damaged, the product cannot be put back on sale. L&W Customer Service will refund 75% of the total amount. Damaged or used products (e.g. broken tip, scratches, marks, smells...) will not be refunded.
It is important to note that rusty knives or utensils are not covered by the warranty, as rust is not considered a product defect, regardless of the length of use (short or long). In fact, rust is the result of too many environmental factors, or of inappropriate use or maintenance.
In the event of improper returns, Knife leader reserves the right to refuse a subsequent order.
Exceptions to the right of withdrawal
The supply of goods whose price depends on fluctuations in financial market rates, the supply of goods made to the customer's specifications or clearly personalized or which, due to their nature, cannot be returned or are likely to deteriorate or expire quickly.
Refund and right of withdrawal
This right of withdrawal is exercised without penalty, with the exception of the initial shipping costs. In the event of exercising the right of withdrawal, the customer has the choice of requesting either a refund of the sums paid ( excluding initial delivery costs), or an exchange of the product. In the case of an exchange, reshipment will be at the customer's expense. This period is deemed to have been respected if the goods are returned before the 60-day period has expired.
If the right of withdrawal is exercised, L&W will make every effort to reimburse the customer within 14 days of the customer's request.
However, in view of the technical nature of the products sold, this period may be extended to 30 days, in particular when the product requires technical verification (cf. products requiring prior testing).
If the product arrives damaged at the customer's address, the customer will be reimbursed by crediting his bank account in the case of payment by credit card, or by cheque in other cases, or in the form of a credit note if the customer requests it, including delivery costs (with the exception of additional costs arising from the fact that the customer has chosen, in any case, no later than fourteen days from the date on which the company is informed of the customer's decision to cancel. L&W will proceed with the reimbursement using the same means of payment as the one used by the customer for the initial transaction, unless the customer expressly agrees to a different means; in any case, this reimbursement will not incur any costs for the customer.
However, the company may defer reimbursement until it has received the goods or until the customer has provided proof of shipment of the goods, whichever comes first.

Article 17 : Force majeure
Neither party will have failed in its contractual obligations to the extent that their performance is delayed, hindered or prevented by an act of God or force majeure. An act of God or force majeure shall be deemed to be any facts or circumstances that are irresistible, external to the parties, unforeseeable, unavoidable, beyond the control of the parties and which cannot be prevented by the latter, despite all reasonable efforts. The party affected by such circumstances will notify the other within ten working days of becoming aware of them. The two parties will then meet, within a period of one month, unless this is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which performance of the contract will continue. If the case of force majeure lasts longer than three months, the present general sales conditions may be terminated by the injured party. The following are expressly considered as cases of force majeure or fortuitous events, in addition to those usually accepted by the jurisprudence of French courts and tribunals: blockage of means of transport or supply, earthquakes, fires, storms, floods, lightning, stoppage of telecommunication networks or difficulties specific to telecommunication networks external to customers.
Article 18 : Partial non-validation
If one or more stipulations of these general terms and conditions of sale are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain their full force and scope.
Article 19 : Non renunciation
The fact that one of the parties does not avail itself of a breach by the other party of one or other of the obligations referred to in these general terms and conditions of sale shall not be construed as a renunciation of the obligation in question for the future.
Article 20 : Applicable law
These general terms and conditions are subject to French law, regardless of any rules regarding conflicts of laws. This applies to both substantive and procedural rules. In case of disputes, the customer may file their complaints with L&W's Customer Service in order to seek an amicable solution.
In the absence of an amicable agreement between the parties, the dispute will be submitted to French courts. Except for natural persons for whom the competent courts will be determined by the provisions of the Code of Civil Procedure, in the event of a dispute regarding the interpretation, execution, or termination of these terms, the Commercial Court of Grasse will have exclusive jurisdiction, regardless of any rules regarding conflicts of laws. This jurisdiction shall also apply in the case of multiple defendants or third-party proceedings.
Article 21 : Information Technology and Freedoms
The information requested from the customer is necessary for the processing of their order and may be shared with contractual partners of the company L&W involved in the execution of this order. The customer can write to the company L&W KNIFE LEADER - Marketing Department, 245 Allée Louis Blériot, Résidence Mandelieu 2000 - 06210 MANDELIEU - France, to object to such communication or to exercise their rights of access and correction regarding the information concerning them that is present in the files of the company L&W, in accordance with the provisions of the law of January 6, 1978.
Article 22 : Customer Mediation Service
In accordance with the amicable resolution of disputes between the professional and the customer, in accordance with Articles L611-1 to L 641-1 and R 612-1 to R 616-2 of the Customer Code, in case of unresolved disputes between the Professional and the Customer, the customer may contact the customer mediator. Before contacting the customer mediator, the customer must have already attempted to resolve the dispute directly with the professional through a written complaint or have filed a complaint as per the terms of the contract concluded with the professional. Customer mediation is an out-of-court resolution process for customer disputes. If the conditions are met, customer mediation will proceed according to a specific process and in accordance with current regulations. The procedure is free of charge for the customer (R612-1 of the Customer Code).
